Before proceeding with the purchase of a product, please read carefully these General Conditions of Sale (“General Conditions”) that have as their object the discipline of the purchase of the products made available on our website www.vituliashop.com (in the following, the “Site”) in compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, “Consumer Code”).
The seller of the products and owner of the Site is: Motherland Food Srl. Its registered office is in via Alessandro Turco n. 93, 88100 Catanzaro, C.F/ P.I. n. 03383930793 – E-mail address: info@vituliashop.com “Motherland Food Srl”.
We remind you that the General Conditions constitute a binding agreement. They are always available to you on the Site and can be consulted at any time through the link that you will receive in the e-mail confirming your order and that we keep to allow its reproduction and storage.
The contracts concluded with Motherland Food Srl through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian.

Add a product to your cart
Enter the product tab to buy and after choosing and selecting the quantity required through the indicators, click on the button ” add to cart”.
The product is now inserted in your cart; Repeat the operation for all the products you intend to buy.

Important: Indicate if you are a private person or a company, by filling in the required fields, so you can receive the receipt or electronic invoice directly in your order! We remind you that if you are a person who requires the issuance of an invoice and/or in any case you are not a “consumer or user” as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, will not apply the rules of withdrawal referred to in art. 7 of these General Conditions and, more generally, the provisions that, according to the same Consumer Code, apply only to “consumers”.
- Choose a payment method
The payment methods available are three: “cash on delivery”, “paypal/card” and “bank transfer”.
Cash on delivery: payment is made on delivery, directly to the courier. We recommend that you prepare the exact amount to pay beforehand as the couriers have no change.
Paypal/Card: select the payment method by card (“Pay with Paypal or credit card”) and you will be redirected/to on the platform managed by Paypal for card payments (accepted circuits: VISA, MASTERCARD, ).
At this point, if you have a Paypal account associated with your bank account, you can proceed with the payment by logging in, or if you are not a member of the Paypal platform, you can select the “Pay with a card” button and proceed with the entry of your card details.
Bank Transfer: by selecting the item “Bank Transfer” you will see a drop-down menu with the data needed to make the transfer through your credit institution. With this type of payment, the order will be processed and the box will be sent only upon receipt of the bank transfer by the administrative office of Motherland Food Srl. The maximum duration of an pending order, with this payment method, is 3 working days from the date of the order, beyond which it will be automatically cancelled by our system. and the goods made available again for purchase by other customers.

Review your order and, if everything is correct, to complete Accept “Terms and Conditions” and decide whether to subscribe to the newsletter, then press the “Finish the order” button.
By sending the order from the Site, which has the value of a contractual proposal, you acknowledge and declare that you have read all the information provided to you during the purchase procedure and to accept in full these General Conditions and payment transcribed, as well as the Privacy Policy.
Upon receipt of the order we will verify the actual availability of the Products ordered; in the event that one or more Products are not available Motherland Food Srl will proceed with the replacement of the Product with a similar one. If you prefer, you can contact us by email at info@vituliashop.com and choose to be contacted by this company for the proposal of alternatives; or you can opt for the replacement of the missing product with a similar one, updating the Cart. In case of one or more missing Products, Motherland Food Srl will not charge the relative price. In the event that the payment of the order has been made by bank transfer, the refund will take place in the manner described in point 5.3 of these General Conditions.
- Information on the Products
All information and features related to the Products are available, with the relevant product codes on vituliashop.com.
The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the descriptive card. It is understood that the image of the Products has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics and quality but may differ in color and size. In case of difference between the image and the written product sheet, the description of the product sheet is always valid.
- Prices and dispatch of products
The prices of the Products are inclusive of all taxes. All prices are in Euro.
Prices may be subject to change and may vary from time to time on the Site. We invite the customer to check the final price of the sale before sending the relevant order form.
When placing the order, the customer will be asked the ZIP code of the address to which he intends to send the Products. The system will check in real time whether a Free and/or Standard Delivery service is available for this destination. If the area is not covered by this service, shipping fees will be charged specifically indicated on the site (in Euros and including VAT) before confirming the order. Motherland Food Srl makes deliveries only in the manner and areas specified on the Site on the basis of the ZIP inserted, therefore it does not assume any responsibility and does not guarantee delivery for any incorrect addresses or not covered by the specific service.
Shipments in Italy:
For shipments of Products Motherland food Srl uses the services of various couriers between BRT, SDA, GLS, UPS, POSTE ITALIANE. The delivery costs are displayed directly at the cash desk under Checkout (in Euros and inclusive of VAT), before the order confirmation. Shipping is free for orders over 49,00 EURO. For orders less than 49,00 the shipment is free only if expressly indicated.
Delivery facilities for Catanzaro City.
In order to facilitate the online shopping service for people with residence or domicile in the town of Catanzaro with ZIP 88100 indicated in the appropriate form “billing details”, Motherland Food Srl reserves free delivery in all periods, in any time slot only to the address indicated by the customer.
Shipments to Abroad:
In Europe, shipments may take place with different couriers depending on the country of destination.
In any case, they will not include packages weighing more than 31Kg. For orders over 99,00 € shipping is free in the countries listed below.
Countries in which the service is active: Austria, Belgium, Bulgaria, Croatia, Denmark, Estonia, Finland, France, Germany, Greece, Ireland, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Principality of Monaco, Czech Republic, Romania, Slovakia, Slovenia, Spain (except the Canary Islands and Ceuta and Melilla), Sweden, Hungary.
Currently there is no delivery in the UK.
5.Methods of payment and invoicing
5.1 Accepted payment methods
Payments can be made by Credit Card (all) and Paypal. It is also possible to pay by bank transfer. In this case, the customer is asked to inform Motherland Food Srl by sending a copy of the bank transfer by e-mail to the address: ordini@vituliashop.com.Then the shipment will start immediately. Another form of payment is cash on delivery, which involves an additional cost of 5 EURO.
Credit card
The circuits on which you can buy within the Site are:
- Visa / Visa Electron
- Mastercard
The Reference Credit Institution uses the SSL protocol to encrypt the data transmitted between its server and the Customer’s browser. To ensure maximum security, the Customer will make the payment transaction directly on the secure server of the bank.
- Paypal
Once the order is confirmed, the Customer will be redirected to the Paypal site where he can make payment with his account or using a card, also prepaid, or in any case according to the methods accepted by Paypal and in compliance with the relevant conditions.
- Bank transfer
The Customer must make the transfer within 3 days from the date of the order. In case this does not occur, the order will be cancelled and the goods made available again for purchase by other customers. The Customer who has not provided for the transfer can be contacted by the Customer Service in order to clarify whether the reason for the failure to credit is due to the Customer’s will not to confirm the purchase or other causes.

Reason: the Customer must indicate in the purpose of the transfer the date and the order number, available in the confirmation e-mail received at the time of confirmation of the order of the Products (e.g. 01/01/2022 Order n. 100052).
- Mark
This payment method is only available for shipments made in Italy and only for orders of no more than 150 €. Payment will be made upon receipt of the Products and may be made exclusively in cash. For shipments on delivery, the customer is required to pay a shipping fee of EUR 5.00.
5.2 Invoicing of orders
If you are a professional, it will be possible to request the issuance of the invoice by selecting the appropriate box during the order procedure and entering the billing data including tax number and/or VAT number and certified email address. In this case the invoice will be sent by e-mail to the address indicated. If the invoice is not requested at the time of order, it will not be possible to request it later.
- Shipment and delivery of products
The shipment is made with the first courier available among the following: GLS, BRT, SDA, UPS, POSTE ITALIANE with delivery from Monday to Friday, in normal office hours, except for national holidays.
To avoid inconvenience, we invite the Customer to provide us with an address where there is always someone who can pick up the goods and provide us with a valid phone number, so that the Courier can contact him if needed.
If you have chosen to pay by bank transfer, Paypal or other credit card shipment will be made after receipt of payment.
For orders by bank transfer, shipments will be made upon receipt of the bank transfer.
Orders placed on Friday after 11.00 am; Saturday and Sunday will be tried the following Monday.
No liability can be attributed to Motherland Food Srl in case of delay in the fulfillment of the order or delivery of what ordered. At the time of delivery of the goods by the courier, the customer is required to check: that the packaging is intact, not damaged, nor wet or otherwise altered, even in the closing materials (adhesive tape or protective cardboard). Any damage must be immediately reported to the courier who delivers. Once the courier’s document has been signed, the Customer will not be able to contest the external characteristics of what has been delivered. In the event of failure to collect within 5 working days of the material in stock at the warehouses of the courier, due to repeated impossibility of delivery to the address indicated by the customer at the time of the order, the order will be automatically cancelled, with charge to the customer of the return costs.
The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate field “Shipping Data” or ” Billing Details”.
On request, shipments abroad may take place with different couriers and conditions depending on the country of destination in order to ensure the best rate available to the customer.
- Right of withdrawal
The Customer has the right to withdraw from the purchase contract for any reason, without having to provide any explanation and without any penalty, except in the cases of exclusion provided for in point 4 below.
To exercise this right, the Customer must send to Motherland Food Srl a communication within 14 days from the date of receipt of the Products using this withdrawal form or, if he intends to exercise the withdrawal before receiving the Products, Notice of withdrawal may be sent at any time prior to their receipt.

Motherland Food Srl will provide, once received the communication, to open a practice for the management of the return and to communicate to the Customer the instructions on the method of return of the Products, which will take place by courier indicated by Motherland Food Srl itself.
The right of withdrawal is governed by the following conditions:
- The right applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise the withdrawal only on part of the Product purchased.
- In case of exercise of the right of withdrawal Motherland Food Srl will refund the customer the full amount of the returned goods, excluding shipping costs where provided, within 14 days from the date on which it was received the notice of withdrawal, without prejudice to the right of Motherland Food Srl to suspend the payment of the refund until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer, unless the latter has expressly requested a different method. In case of bank transfer or cash on delivery it will be the Customer’s responsibility to provide the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN).
- The Products must be returned in the same box in which they were received.
- In addition to the cases indicated in Foreword (consumer and/ or customer who requires the invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 d.lgs 21/2014:
– the order of products by a non-consumer customer and/or that requires an invoice;
– the order of tailor-made or clearly customised products;
– order of sealed products which are not suitable for return for hygienic or health protection reasons or which have been opened after delivery;
– order of products likely to deteriorate or expire rapidly.
With reference to the cases of exclusion of withdrawal listed above, the Customer, in particular, is informed and accepts that among the Products that “risk to deteriorate or expire quickly” include both all Food Products (including wines, spirits and beverages) both cosmetics, as the characteristics and qualities of these types of Products are subject to alteration also as a result of improper storage. Therefore, for hygienic and customer protection reasons, the right of withdrawal is only applicable for products purchased on the Site that can be returned to Motherland Food srl and put on the market without danger to the health of consumers (such as books, gadgets, kitchen utensils, etc.).
In cases of exclusion of the right of withdrawal, Motherland Food Srl will return to the customer the purchased products, charging the same shipping costs.
8. Warranty and lack of conformity
In case of defects of conformity of Products sold by Motherland Food Srl you can send a communication to customer@vituliashop.com and immediately contact the Company Motherland Food Srl by telephone: +39 0961 728218 or +39 3930327827.
The legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. You have the right, at its choice and provided that the type of Product allows it, to restore, at no cost, the conformity of the Product by repair or replacement, or an appropriate price reduction or termination of the contract. The Customer forfeits these rights if he does not report to Motherland Food Srl the lack of conformity within 30 days from the date on which he discovered the defect, provided that it is not a Product that by its nature is perishable or subject to expiry in a shorter period, in which case the defect must be reported within that reduced period.
9. Errors and limitations of liability
The information about the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors of which Motherland Food Srl cannot be held liable, except in case of intent or gross negligence.
Motherland Food Srl reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update the information at any time without prior notice, without prejudice to the rights of the Customer pursuant to these General Conditions and the Consumer Code.
Except in the event of intentional or gross negligence, any right of the Customer to compensation for damages or to the recognition of compensation, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or evasion, even partial, of an order.
10. Cancellation, postponement or modification of the order’s shipping address
The Customer may cancel, postpone or request the change of shipping address of the order within a limited period of time from the conclusion of the order; in the case of Standard Delivery this limit is 12 hours. After this maximum period, the order will be processed and it will no longer be possible to request cancellation or change of shipping address.
The Customer must contact the Customer Service directly from the Site using the appropriate contact form accessible in the area dedicated to Customer Service.
Motherland Food Srl reserves the right to cancel the order in case of unforeseeable difficulties, informing the customer by e-mail, or, upon agreement with the same, change the day and/ or time of delivery.

12. Online resolution of consumer disputes (ODR)
Pursuant to art. 14 of Regulation 524/2013 informs the user that in case of dispute may submit a complaint through the ODR platform of the European Union reachable here. The ODR platform is an access point for users who wish to resolve disputes arising from online sales or service contracts in an out-of-court manner.
13. Applicable law and jurisdiction
The sales contract between the customer and Motherland Food Srl is concluded in Italy and regulated by Italian law. For the resolution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders, if the Customer is a consumer pursuant to the Consumer Code, In all other cases, the territorial jurisdiction is exclusively that of the Court of Catanzaro, any other jurisdiction excluded.
