Your contract with us is governed by Italian Law and the language used is Italian.
2. Chose and order the Products
To place an order for the purchase of one or more products on vituliashop.com, you must fill out the on line order form and send it electronically following the relevant instructions on the website.
The order form contains a link to these General Terms and Condition of Sale, the relevant unit price ( including taxes), the type of payment that you may use in order to purchase each product, shipping terms for the purchased products, shipping and delivery costs, and references to the terms and conditions for returning purchased products, in accordance with consumer protection legislation.
2.1 An order shall be deemed submitted when MOTHERLAND FOOD Srl receives your order form electronically and the order information has been verified as correct.
2.2 Before submitting your order form for the purchase of products, you will be asked to carefully read the General Terms and Condition of Sale and to identify and correct possible input errors.
2.3 After your order form has been submitted, MOTHERLAND FOOD Srl will process your order.
2.4 The purchase order is completed when the “ consumer “ receive an e-mail that confirm the purchase order.
2.5 Before completing your order, we remind you to make sure that it does not contain any errors and that the data entered for shipping is correct. Any discrepancies or errors will have to be promptly communicated. If we don’t receive any communication within 12 hours of receipt of the order, this will be put in processing for shipment.
We will inform you immediately in the case of one or more products are not available, including any possible delivery date.

3.1 The main characteristics of products and their ingredients are shown on vituliashop.com on each product page. The products offered on sale on vituliashop.com may not exactly correspond to real garments in terms of image and colors due to Internet browser or monitor used. If there is a difference between the image and the description of the product, the description of the product prevails .
3.2 On vituliashop.com we offer for sale luxury food and top-quality products.
All prices are in EURO and are inclusive of VAT.
Prices are subject to change and will be as quoted on our site from time to time, except in case of obvious error. Check the final price of sale before sending the relevant order form
- Shipping and Delivery of the Products
UPS is our courier for all shipments in Europe. Delivery is guaranteed on the 5-7 working day for orders placed by 11.00 a.m. GMT. Working days are Monday to Friday. All orders are shipped from Italy.
The shipping cost varies according to your country destination, it is in Euro and inclusive of VAT. Now in EUROPE Shipping is free for orders above 150,00 EURO. You will receive an email containing your Tracking Number once your package has been shipped from our Italian warehouse.
4.1 SDA is our courier for all shipments in Italy . Delivery is guaranteed on the 2nd working day for orders placed by 11.00 a.m. GMT. Working days are Monday to Friday.
4.2 No liability can be attributed to MOTHERLAND FOOD Srl in case of delays in ordering or delivery of what is ordered, due to the courier
At the time of delivery of the goods by the courier, the Consumer is obliged to check that the packaging is intact, not damaged, neither wet nor otherwise altered, even in the closing material (adhesive tape or metal strips).
4.3 Any damages must be immediately disputed by the courier who carries out the delivery. Upon signing the courier document, the Consumer will not be able to challenge any of the external features of the delivery.
4.4 Products purchased on vituliashop.com will be delivered to the address indicated by the Consumer during the purchase procedure in the “Shipping Data” field. In the event of a delivery failure due to the wrong destination address indicated on the purchase order by the consumer, the storage and return costs of products will be charged to the consumer.
5. Payments Methods
Payments of the product prices and relevant costs for shipping and delivery must be made using one of the procedures indicated on the order form on vituliashop.com
Vituliashop.com accepts the following payment methods:
– PayPal: Shop easily online without having to enter your credit card details on the website.
Your account will be charged once the order is completed. To register for a PayPal account, visit the website paypal.com.
– Bank transfer: For bank transfer please read the data below.
In this case you must notify us your payment by e-mail to email@example.com within 3 days from the purchase. The purchased products will be ready for shipping after our bank will receive your payment. If after 3 days after we receiving the order purchase our bank don’t receive any payment the order will be cancelled and the products will be available for other clients.

Consumer must indicate the date and order number in the transfer order, which can be found in the confirmation email (eg “Order 01/01/17 No. 100012345”).
-Cash on Delivery: At time of delivery, you must have the exact order total indicated in the shipping confirmation email in cash. The courier cannot provide change and does not accept cheques. For eventual refunds, you must indicate a bank or postal account. This payment method has an additional cost of EURO 5,00 or £5.00
The invoice will be included in your package.
Unfortunately we are unable to modify invoices which have already been issued.
In order to avoid export issues and delivery delays, the products and prices listed on the invoice must match the actual contents of your package.
7. Consumer Rights, Exchanges and Return of Products, in accordance with consumer protection legislation.
In accordance with consumer protection legislation, you have the right to cancel your contract with MOTHERLAND FOOD Srl in relation to products purchased from vituliashop.com, without any penalty and for any reason – except for the products mentioned at point numeb 7.4 “f” letter below– by notifying MOTHERLAND FOOD Srl in writing using this Form within fourteen ( 14) calendar days, beginning on the day you receive the products.

7.2 After receiving your cancellation form, you will receive a full refund of the price of the products except for the delivery costs.
7.3 You should return the products to MOTHERLAND FOOD Srl within fourteen (14) calendar days of the date you notify MOTHERLAND FOOD Srl of the cancellation, in the same condition in which you received them and at your own expense. You have a legal obligation to take reasonable care of the products whilst they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.
7.4 The right to return – in addition to compliance with the terms and procedures above – is exercised properly when the following conditions have also been met:
- the products should be returned in not have been used, or damaged;
- the products should be returned, complete. if you want to return a kit or a gusto box, it should include all of its components;
- the products should be returned to Motherland Food srl within fourteen (14) calendar days of the date you notify us of your decision to cancel.
- Refund will be made using the same payment method used by the Customer, unless he has expressly requested a different mode of payment . In the case of a wire transfer or payment, the customer will be required to provide the banking coordinates on which to obtain the repayment (account holder, name and address of the Bank and IBAN).
- Products must be returned in the same box as they were received.
7.5 The right of withdrawal is excluded in the following cases, pursuant to art. 59 d.lgs 21/2014:
- Customized or clearly customized products;
- Sealed products that can not be returned for health or health reasons or which were opened after delivery.
8. Products returned because they are damaged, defective or incorrect

8.1 If you are returning a product because of an error on our part or because it is damaged or defective, we will refund the delivery charges incurred in sending the item to you and pay your costs of returning it to us refunding your return postage costs). ; except for the products mentioned at point numeb 7.4 “f” letter below–
8.2 You must notify MOTHERLAND FOOD Srl of an error in respect of the products delivered or of a damaged or defective product within thirty (30) days of receipt. You must return the products in the same condition in which you received them. You have a legal obligation to take reasonable care of the products whilst they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

These General Terms and Conditions of Sale are governed by Italian lawand in particular by Italian legislative decree 6 September 2005 no. 206 on distance contracts and by Italian legislative decree 9 April 2003 no. 70 on certain aspects related to e-commerce.
For settlement of disputes relating to the interpretation, execution or termination of these General Conditions or individual purchase orders the territorial jurisdiction is exclusively that of the Foro di Catanzaro, any other competent forum excepted.
